Welcome to Calyraen. These Terms of Service ("Terms") set out the rules for using our website, our accounts, and the products and services we offer through it. Please read them carefully. By using the site or creating an account, you agree to these Terms. If you do not agree, please do not use the site or our services.

1. About these Terms
Calyraen designs and builds its own computers (including Stratus laptops, Vantage desktops, Atlas workstations, and Forge servers), writes the operating system that runs on them (Calyraen OS), and operates a range of platforms and services across creator and seller tools, banking and travel, entertainment, and our Foundation. This website is one way we let you learn about, buy, and manage those products and services.
In these Terms, "Calyraen," "we," "us," and "our" refer to our registered entity and its affiliates. "You" and "your" refer to the person or organization using the site. "Services" means the website and the accounts, products, features, and content we make available through it.
Some of our products and services have their own separate agreements (for example, banking, airline, or platform terms). Where a separate agreement applies to a specific service, that agreement governs your use of that service. These Terms cover your general use of this website and anything that does not have its own terms.
2. Acceptance of the Terms
By accessing or using the site, browsing our pages, creating an account, or placing an order, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy and Cookie Policy. If you are using the Services for a company or other organization, you confirm that you have the authority to accept these Terms on its behalf, and "you" includes that organization.
If you do not agree with any part of these Terms, you should stop using the Services.
3. Who may use the Services
Eligibility
You may use the Services only if you can form a legally binding contract with us and are not barred from doing so under applicable law. You must be at least the age of majority in your country or region, or have the consent of a parent or legal guardian who agrees to these Terms on your behalf. Some products and services may have their own, higher age or eligibility requirements, and we will tell you when they apply.
You may not use the Services if we have previously suspended or removed your access, unless we agree in writing to let you return.
Accounts
You may need an account to use some features, place orders, or manage services. When you create an account, you agree to provide accurate, current, and complete information, and to keep it up to date. You are responsible for everything that happens under your account.
Account security
Keep your login details confidential and do not share them with anyone. Use a strong, unique password, and enable any additional security features we offer. Tell us right away, through our contact channels at /support/contact, if you think your account has been accessed without your permission or if there has been any other breach of security. We are not responsible for losses caused by someone using your account with your details, whether or not you authorized it, to the extent the law allows.
4. Use of the website and Services
We grant you permission to use the Services for your own personal or internal business purposes, in line with these Terms. You agree to use the Services only for lawful purposes and in ways that do not interfere with others' use of them.
We may add, change, suspend, or remove features of the Services at any time. We may also set limits on how you use certain features, or restrict access to parts of the Services, without notice and without liability to you, so long as we do so consistently with these Terms. We try to keep the Services available and working, but we do not promise that they will always be uninterrupted, timely, secure, or free of errors.
5. Orders, purchases, pricing, and availability
This section applies when you buy physical products from us, such as our computers and related hardware.
Product listings and availability
We try to describe our products accurately, but product pages, images, specifications, and packaging are for general information and may not be exact. Colors and finishes can look different on different screens. Products are offered subject to availability. Some items may be out of stock, available in limited quantities, or shown for information only and not yet available to buy. Listing a product does not guarantee that it is or will be in stock. We may limit the quantity you can order, and we may stop offering any product at any time.
Orders and acceptance
When you place an order, you are making an offer to buy the product at the listed price. Your order is not accepted until we confirm it, and a confirmation of receipt does not by itself mean we have accepted your order. We may refuse or cancel any order, in whole or in part, for reasons that include the product being unavailable or out of stock, errors in the price or product description, suspected fraud, or a problem with payment. If we cancel an order you have already paid for, we will refund the amount charged for the canceled items.
Pricing and payment
Prices are shown in the currency stated at checkout and may not include taxes, duties, shipping, or other charges, which will be added where they apply and shown before you confirm your order. We work hard to keep prices accurate, but errors can happen. If we find that a product's price was listed incorrectly, we may cancel or correct the order and, where required, contact you before charging you or shipping the item.
You agree to provide valid, current payment details and confirm that you are authorized to use the payment method you choose. Payments may be processed by third-party payment providers, and their terms may also apply.
Shipping, returns, and warranties
Delivery times are estimates and are not guaranteed. Risk of loss and title for physical products pass to you when they are delivered to the carrier or to you, as set out in the details at checkout or in a separate shipping, return, or warranty policy. Any hardware warranty, return window, or refund process will be described in the applicable policy provided with the product or at checkout. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
6. Intellectual property and your license to use the site
The Services, including the website design, text, graphics, logos, images, software, Calyraen OS, and other content we provide, are owned by Calyraen or our licensors and are protected by intellectual property and other laws. "Calyraen," our product names, and our logos are our trademarks. You may not use them without our prior written permission.
We grant you a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the site and its content for your own personal or internal business use, subject to these Terms. This license does not let you copy, reproduce, distribute, publicly display, modify, create derivative works from, sell, rent, reverse engineer, or otherwise exploit any part of the Services or its content, except as the law allows or as we expressly permit in writing.
Any software we provide to you is licensed, not sold, and is subject to any separate license terms that come with it. If you send us feedback, ideas, or suggestions about the Services, you agree that we may use them freely, without any obligation to you.
7. Acceptable use and prohibited conduct
You agree not to misuse the Services. In particular, you agree that you will not:
- break any applicable law or regulation, or encourage others to do so;
- infringe our intellectual property or the rights of anyone else, including privacy and publicity rights;
- upload, post, or share content that is unlawful, harmful, harassing, defamatory, hateful, obscene, or otherwise objectionable;
- impersonate any person or organization, or misrepresent your connection with anyone;
- try to gain unauthorized access to any account, system, or network, or to any data you are not meant to see;
- introduce viruses, malware, or other harmful code, or interfere with or disrupt the Services, servers, or networks;
- probe, scan, or test the vulnerability of the Services, or get around any security or access controls, without our permission;
- use automated tools such as bots or scrapers to collect data or access the Services in a way that places an unreasonable load on our systems, except as we expressly allow;
- use the Services to send spam or other unsolicited messages, or to carry out fraud; or
- use the Services in any way that could damage, disable, overburden, or harm Calyraen or interfere with anyone else's use of them.
We may investigate and take action against conduct that we believe breaks these rules, including removing content and suspending or ending access, and we may report suspected unlawful activity to the authorities.
8. Third-party services and links
The Services may link to, or work with, websites, products, and services operated by others. We provide these links and connections for convenience and do not control, endorse, or take responsibility for third-party content, products, or practices. When you use a third-party service, that party's own terms and privacy policy apply, and any dealings you have with them are between you and them. We are not responsible for any loss or damage that arises from your use of third-party services.
9. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties that arise from a course of dealing or usage of trade.
We do not warrant that the Services will meet your requirements, that they will be available on an uninterrupted, secure, or error-free basis, that defects will be corrected, or that the Services or the servers that provide them are free of viruses or other harmful components. Any content or advice you get through the Services is used at your own discretion and risk.
Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you. In that case, our warranties are limited to the shortest extent the law allows.
10. Limitation of liability
To the fullest extent permitted by law, Calyraen and its affiliates, and our officers, employees, agents, and suppliers, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Services, even if we have been advised that such damages are possible.
To the fullest extent permitted by law, our total liability for all claims relating to the Services will not exceed the greater of (a) the amount you paid us for the product or service that gave rise to the claim in the twelve months before the event that caused the claim, or (b) one hundred US dollars (or its equivalent).
Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including liability for fraud, for death or personal injury caused by negligence, or for any other liability that the law does not allow us to limit. Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Calyraen and its affiliates, and our officers, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, that arise out of or relate to your use of the Services, your breach of these Terms, your violation of any law, or your infringement of the rights of any third party. We may take over the defense of any matter subject to indemnification by you, at your expense, and you agree to cooperate with us in that defense. You may not settle any matter in a way that affects us without our prior written consent.
12. Suspension and termination
You may stop using the Services at any time, and you may close your account by contacting us at /support/contact.
We may suspend or end your access to the Services, in whole or in part, at any time, with or without notice, if we reasonably believe that you have broken these Terms or any applicable law, if doing so is needed to protect the Services, other users, or Calyraen, or if we stop offering the Services. Where it is practical and lawful to do so, we will try to give you notice.
If your access ends, the rights we granted you under these Terms will stop, but any sections that by their nature should continue (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will remain in effect. Ending your access does not affect any order, payment, or obligation that arose before it ended.
13. Governing law and dispute resolution
These Terms, and any dispute arising out of or relating to them or the Services, are governed by the laws that apply where our registered entity is established, without regard to conflict of law rules, and subject to any mandatory consumer protection laws of the country where you live.
If a dispute arises, we encourage you to contact us first at /support/contact so we can try to resolve it informally. If we cannot resolve it that way, the dispute will be handled through the courts or dispute resolution process that applies in the location of our registered entity, unless applicable law gives you the right to bring a claim in the courts where you live. Nothing in this section prevents either of us from seeking urgent relief, such as an injunction, from a court where appropriate.
14. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes to our Services, our business, or the law. When we make changes, we will post the updated Terms on this page and change the "Last updated" date above. If the changes are significant, we will try to give you additional notice, such as a notice on the site or a message to your account. Your continued use of the Services after the updated Terms take effect means you accept the changes. If you do not agree with the updated Terms, you should stop using the Services.
15. General
These Terms, together with any policies or additional terms they refer to, make up the entire agreement between you and Calyraen about your use of the Services. If any part of these Terms is found to be unenforceable, the rest will stay in effect. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not transfer or assign your rights or obligations under these Terms without our consent, but we may transfer ours as part of a merger, acquisition, or sale of assets, or as otherwise allowed by law. Headings are for convenience only and do not affect how these Terms are read.
